		<description>Waitaminute - let's not just talk about the tainted supplements. Sherk also thinks that because the chain of custody at the testing site was inadequate somebody might have tainted his sample. And he's pretty sure that there was carryover from a previous test. 

That's throwing shit at a wall. And polygraphs don't prove anything: that's why they aren't admissible in court.

This all reminds me of the story (which is meant to illustrate something about Rabbinical law, I think) of the guy who borrowed a plate from his neighbor. He brings it back broken and says, "I never borrowed it. It was broken when I got it. It was fine when I returned it." Just like with Sherk, not all of these can be true. You can't say, "There were steroids in my piss from the supplements. But there weren't any steroids in my piss until they tainted the sample. And the sample wasn't tainted, the lab equipment was." These CANNOT all be true.

See I ask about willfulness because that is the factor that separates crimes like manslaughter from aggravated murder. Our entire national justice system is based around findings of willfulness, or a lack thereof. That and serving your time. Hmm. Also the right to appeal, I mean what if an innocent man was found guilty - you know, theoretically.

Now, I prefer BJ Penn's fighting style to Sherk's, no doubt about it. I think Penn is also the more skilled athlete. I can hold those views without needing to attack a guy for buying a supplement which contained an illegal substance.  And yes, he was responsible for for what was in his body, so he spent six months on the bench serving his sentence. And his fine remained, so he paid that. And he was stripped of the title. I think he's got the point.
