Court Win Puts Couture One Step Closer to Fedor

(Randy Couture: Even his cauliflower ear is smiling.)
Yesterday, the District Court of Dallas County, Texas, denied three motions filed by Zuffa to stay, delay, and/or dismiss HDNet's challenge of Couture's promotional contract with the UFC. Zuffa claims that Couture still owes them two bouts on his contract, while Couture is arguing that the contract will expire in July, after its 16-month term concludes.
The decision will now allow HDNet's motion for a summary judgment to be heard on June 2nd. HDNet first brought this suit against Zuffa in February, stating that they had a business arrangement with Couture that required a decision on his promotional contract status with the company. If this leg of Couture's legal marathon goes his way, he'll be an official free-agent once the one-year non-compete clause in his employment contract expires in October, and will finally be able to set up a fight with his personal white whale, Fedor Emelianenko.
In a separate lawsuit being heard in Las Vegas, Zuffa is suing Couture for breach of contract stemming from his (and Xtreme Couture's) former association with the IFL. Zuffa is also seeking a ruling on Couture's fight contract, though a judgment in Texas could affect Zuffa's case. Or, for you law school geeks, "due to the legal doctrines of res judicata, collateral estoppel, and the full faith and credit clause, the first ruling issued will most likely decide the matter." I don't know what that means, and I don't want to know. But come on, Zuffa — can we just let Fedor kick Randy's ass so we can all move on with our lives?

BOOO! Randy shoulda just fulfilled his contract and then there would be nothing to worry about when is 16 months was up. what a waste of time. If it was his pride that randy worried about keeping, he shoulda just moved to japan.

I am sad, I want to see Couture v. Big Nog, but I never will. Hopefully Fedor will lose to Sylvia (hopefully I will win the lotto) and then Randy will be less enamored with a Fedor fight and I can get my wish.

Am I the only one that doesn't think Fedor could kick Randy's ass?
Will Says:
as an attorney what that means is that a subsequent court will honor and abide by a prior court's ruling on the issue as a whole, i.e. if the Texas court finds that Randy's contract will expire with the UFC in July then the Nevada court will honor that ruling, or give it full faith and credit.
Will Says:
what I have always found interesting about Randy is that as I understand it he asked the UFC to pursue Fedor aggressively but then got pissed later with the amounts that they had offered him to join. Nice catch 22 there, in my opinion.
C-Bus Allstar Says:
Question is Will, was Randy pissed that they offered him too much (inherently hurting Randy's feelings that Fedor was getting paid more than him), or that they didn't offer enough (which angered Randy that they weren't seeking Fedor aggressively enough)..?

yep, pretty much. we will know a little more about where f.e. is in July, but as of right now he is the baddest hw on the planet (sorry kimbo boys).
BC Law School Geek Says:
The legal jargon you mentioned basically means that Zuffa litigate issues or claims the court finds have been resolved in the first decision (likely the employment contract claims) in their subsequent claims. Otherwise, Zuffa may be able to pull more things out of their a$$ to stall even longer.
Draconis Says:
Fedor will destroy randy.
