Authentic Brands Group Lays the Smackdown on Cancer Non-Profit Over ‘Tapout’ Usage

Apparently Dana White isn’t the only person in the MMA community who keeps a cease and desist in their back pocket, eagerly awaiting to ruin someone’s fun.

MMAPayout.com is reporting that Authentic Brands Group, owner of MMA brands Sinister, Silverstar and Tapout, has officially served notice to the non-profit cancer awareness company Tap Out Cancer over the use of a federally trademarked word ‘tapout’.

All I can think about is Mask rolling over in his grave right now. First the “bro deals” went out the window and now this. I understand the business logic behind the decision. However, I feel it’s a missed opportunity for the most recognizable MMA apparel company to have a positive impact in the lives of others while gaining the hearts of media everywhere. What do you guys think?

That's the best looking Tapout shirt right there. If i was a fighter in the UFC, i'd totally wear it as to the walk-out.

Fucken unbeleivable, as CP says Mask would not be happy with this bullshit, not everyones apparel of choice, but I think anyone who has any idea of MMA industry history know the philosophy TAPOUT started with, and this shitty decision by the new brand owners is bullshit, MMA orgs(UFC) would do well to embrace these charities, I'm sure the fighters (most) wouldn't begrudge some time for make-a-wish, starlight foundation etc, business is business, but FFS

Next time Rogan and Goldie are calling a fight and someone is caught in a choke, they'd better be saying "he needs to SUBMIT or he's going to sleep". If they say "he needs to tap out" then they might get sued or something. Geez...

I won't jump to conclusions quite yet. It's just a cease and desist order. What probably happened was word got to the lawyers that another company was using their trademarked name, and they issued the CD to at least figure it out. I'm sure once the dust clears, everything will be worked out. From my understanding, the surviving co-founders of TapOut are stand up guys and I seriously doubt they would want to take away from the charity.

Saying "fat mexicans" isn't being racist, it's being descriptive. Apparently he has seen multiple overweight mexican people wearing tap out shirts and starting fights in parking lots in San Diego. He is simply reporting his observations. Stop being so godamn sensitive. Regardless, I doubt anyone will argue that tapout wearing douchebags come in all shapes and colors.

Except that they're not using the Tapout images/logo. They're using the words "tap (space) out". Should Joe Rogan be sued every time he says those words? Should bars be sued when putting informational labels on their kegs? Poop, Poop, Poop.

It seems shitty, but from a legal standpoint, you all but have to do this. If you don't protect your copyright, it is all but open season if you knowingly allow one company to use your images without notice (sets precedent). It's also not as simple as just then licensing the group to use your copyright; you never want to not be in control of what is being produced.
Again, seems shitty, but gots to do it.
